The short version. Use Hoist for your own brands and content. Don't break the law or the rules of the platforms you connect. We're in private beta and things might break. We're not liable if a third-party platform changes the rules out from under us.

Who you are agreeing with

Hoist is operated by X3 E-Commerce LLC, a Wyoming company. When the words "we" or "us" appear below, that's who they mean. "You" means the person or company using Hoist.

What Hoist does

Hoist is a social-media scheduling and publishing tool. You connect your own platform accounts (TikTok, Instagram, X, YouTube and others), upload media and captions, pick a time, and Hoist publishes on your behalf at that time.

You will not use Hoist to:

Your content

You keep ownership of everything you upload to Hoist. You grant us a limited licence to host, transmit and publish that content for the sole purpose of doing what you told Hoist to do with it. We do not use your content for anything else.

The platforms we connect to

Hoist depends on third-party APIs (TikTok, Instagram, X, YouTube, etc.). Those platforms can change their rules, rate-limit, suspend or revoke access at any time. When that happens, Hoist's ability to publish to that platform may be reduced or interrupted. We do our best to keep up, but we are not responsible for problems caused by changes those platforms make.

Hoist is in private beta. That means:

Money

Hoist is free during private beta. If we ever start charging, we will tell you in writing first and you can keep using your existing free access for at least 30 days after that notice, or stop using Hoist with no penalty.

Termination

You can delete your account at any time. We can terminate accounts that violate these terms. On termination, all your data is deleted within 30 days except for what we are required by law to retain.

Disclaimer and liability

Hoist is provided "as is" with no warranties. We are not liable for indirect, consequential, or special damages. Our total liability to you under these terms is capped at whatever amount you have paid us in the prior 12 months, which during private beta is $0.

Governing law

These terms are governed by the laws of the State of Wyoming, USA. Any dispute will be resolved in the state or federal courts located in Wyoming.

Changes

We may update these terms. If we change anything material we will email every account holder at least 14 days before the change takes effect. Continued use after the effective date means you agree to the new terms.
